*933In an action, inter alia, to recover damages for breach of contract, the plaintiff appeals from an order of the Supreme Court, Westchester County (Rudolph, J.), entered January 16, 2008, which granted the defendant’s motion to dismiss the complaint pursuant to CPLR 3211 (a) (7) or, alternatively, to dismiss the complaint, with prejudice, pursuant to CPLR 3211 (a) (10), for failure to join a necessary party.

Ordered that the order is modified, on the law, (1) by deleting the provisions thereof granting those branches of the defendant’s motion which were to dismiss the first, third, and seventh…
