Defendant has moved under Rule 51 of the Rules of the United States Court of Claims for summary judgment on the ground that plaintiff’s petition and documentary evidence submitted By the parties in connection therewith raise no genuine issue as to any material fact and that the defendant is entitled to judgment as a matter of law.
