This litigation arose as the result of the sale of a piece of property on which a *820house had been constructed and is a con-cursus proceeding provoked by the notary public who executed the sale and one mate-rialman. In accordance with the requirements of LSA-R.S. 13:4811-17, the notary deposited in the registry of the district .court for the Parish of Orleans the net ■proceeds from the sale of the property, to-wit, the sum of $16,732.98.
