delivered the opinion of the court.

On July 24, 1938, between one and two a.m. Glenn Lynch, was driving an automobile of the plaintiff, Wayne S. Fox. Thomas Linton was riding in said automobile as a passenger. They were traveling in a northerly direction on a highway known as Illinois State Boute 59. The defendant, Illinois Central Bail-road Company was operating a locomotive engine drawing a freight train consisting of 68 cars along its track which intersects the said public highway.
