Defendant was charged with first-degree murder, MCLA 750.316; MSA 28.548, was convicted by a jury, and appeals. She was charged with having murdered her newborn daughter by starvation.

The child was born February 4, 1971, and weighed seven pounds two ounces at birth. She was an apparently normal child except that she had a cleft palate and harelip. Because of this, the child was kept at the hospital two extra days.
