SHIPMAN, Circuit Judge.

This is an appeal from a. decree of the circuit court for the northern district of New York, upon, a bill in equity which was founded upon Hie alleged infringement by the defendant of letters patent No. 238,156, dated May 16, 1882, to Cleon Tondeur, for itaproveraents in glass-annealing furnaces. The circuit; court rendered, upon final hearing, an interlocutory decree against, the defendant, for on injunction and an accounting.
