This is an action brought by the plaintiff, who 'is -the respondent in this court, against Hyde county and Mary Yean die, defendants and appellants, to vacate and 'set aside a tax judgment and certificate of sale, rendered under what is commonly known as the “Scavenger tax law,” as a cloud on the title to the S. E. of section 24, township 112, range 73, in Hyde county owned by plaintiff.
