This lawsuit arises from the rejection by Defendant Ticor Title Insurance Company (“Ticor”) of a claim by Plaintiff Flagstar Bank, FSB (“Flagstar”) under a title insurance policy purportedly issued by Ticor and assigned to Flagstar (the “Title Policy”). The Title Policy purported to cover a mortgage loan that Flagstar, a federally-chartered savings bank, purchased during the refinancing boom.
