In this action to evict a lessee of real property, plaintiffs Richard Russell and Edward Russell, Jr., appeal as of right from a Ma-comb Circuit Court order granting summary disposition under MCR 2.116(C)(10) in favor of defendant Meehan Companies, Inc. The principal issue presented for our consideration is whether two cotenants of the property (the Russells) can evict a lessee of specific parcels of the property (Meehan) as a trespasser when another cotenant (Chi Beta Limited, Inc.) leased the property in violation of a co-ownership agreement.
