ORDER DENYING MOTION FOR LEAVE TO PRESENT LIVE DIRECT TESTIMONY

I. INTRODUCTION.

Plaintiff William Kuntz III (“Kuntz”) seeks relief from this court’s civil bench trial procedures, which, in most cases, require that direct testimony be presented in the form of affidavits or declarations, with witnesses subject to live cross-examination and live redirect examination (“Declarations Procedure”).
