OPINION

HYDER, Judge.

This is an appeal from a conviction of murder in the second degree with resulting sentence of ten to fifteen years in the penitentiary. The defendant is indigent and represented by appointed counsel.

On September 12, 1968, a Chattanooga City detective found Raeburn Earl Kettle mortally wounded and lying on the floor of his apartment. The victim told the detective that he knew that he was dying.
