Appeal from the St. Louis City Circuit Court. — Hon. Horatio D. Wood, Judge. The ease at bar is not within the rule of Weyrich v. Grand Lodge, 47 Mo. App. 391. Here there is an express undertaking of the grand lodge to pay to the beneficiary. Secs. 5 and 6, Statutes of the Mortuary Fund. All members of the lodge in good standing are members of, and are entitled to participate in, the Mortuary Fund. Sec. 2, Statutes of the Mortuary Fund.

The G-erman Order of Harugari is a national benevolent organization, with state organizations, called respectively “the G-rand Lodge of the German Order of Harugari” of the state where established. The state lodges are incorporated in the various states, and the defendant is the incorporated Grand Lodge for *51the State of Missouri. Under the grand lodges are subordinate lodges, which are not incorporated.
