The present action is based upon a charge of infringement of two patents, issued to Robert V. Cheatham and assigned to the plaintiff. The earlier of these patents, No. 612,-702, was granted upon the 18th day of October, 1898, and the second one, No. 917,541, upon the 25th day of June, 1907.
