Petitioner’s motion for rehearing is overruled. We withdraw our opinion of January 5, 1994, and substitute the following opinion.

This is an appeal from a decision of the State Bar of Texas Board of Disciplinary Appeals (“BODA”) dismissing a Disciplinary Action by the State Bar Office of Chief Disciplinary Counsel (“OCDC”) seeking to disbar Lloyd Humphreys.
