Amongst the most urgent of appellant’s con■tentions are that the circuit court erred in so construing the statute (subd. 1, sec. 2864, Stats. 1898) and the pleadings as to justify a compulsory reference, and that it abused its discretion in the orders made fixing the compensation and expenses of the referees and of the reporter.
