NEALON, Chief Justice.

Willis R. Dearing, surviving member of the partnership of R. H. Dearing & Sons, brought this suit against D. C. Joyner and wife, Moranda Joynex, G. C. Joyner, Evie Joyner, arid L. L. Joyner. For convenience both plaintiff and the partnership are hereinafter styled “plaintiffs.”

Plaintiffs sought a permanent injunction against defendants to prevent interference with the erection of a house on certain described land. Plaintiffs are the assignees of the rights acquired by one Tautenhahn under an oil and gas lease; and it is under and by virtue of the provisions of said lease…
