In an action pursuant to RPAPL article 15 to compel the determination of claims to certain real property, the defendant Peter Bistrian appeals from so much of a judgment of the Supreme Court, Suffolk County (Gerard, J.), entered July 13, 1987, as, after a nonjury trial, declared that the plaintiff was the owner of a portion of the property, and the plaintiff cross-appeals from so much of the same judgment as declared that the defendant Peter Bistrian was the owner of a portion of the premises based on his claim of adverse possession.

Ordered that the judgment is affirmed insofar as appealed…
