Defendant moves for the appointment of a special prosecutor pursuant to County Law § 701.

These are prosecutions for reckless driving (Vehicle and Traffic Law § 1190) and driving while haying .10 of 1% or more of alcohol in the blood (Vehicle and Traffic Law § 1192 [2]). The defendant is a first cousin of one of the Assistant District Attorneys in, this county.
