LOONEY, Justice.

This appeal is from an order, dissolving a temporary injunction. The material facts are these: On November 28, 1939, F. H. McCown recovered judgment in the Justice Court of Precinct No. 1, McLen-nan County, Texas, against J. D. McKinney, for the sum of $69.30. No appeal was prosecuted from the judgment. The suit was based upon a promissory note, executed by McKinney, payable to Mc-Cown, being the initial premium for a policy issued by Texas Life Insurance *790Company, insuring the life of McKinney in the sum of $1,000, McCown being- soliciting agent for the Insurance Company.
