The defendant was convicted as a persistent violator of the prohibitory law and appeals.

The information contained two counts. The first count charged that the defendant was convicted of a violation of the prohibitory law on January 27, 1914, and that subsequently, on February 28, 1914, he sold intoxicating liquor contrary to law. The second count charged the same conviction and that subsequently, on February 28, 1914, the defendant maintained a liquor nuisance contrary to law.
