The only question (raised by demurrer to tbe complaint) for 'decision when this case was here before, (121 N. C., 8,) was whether a married woman, abandoned by ber husband, could maintain without tbe joinder of ber bus-band, an action in tort. Tbe Court held that such an action could be maintained. The present appeal is before us on exceptions to tbe charge of his Honor.
