Defendant is sued upon an accommodation note, given Wallace & Cary, late a commercial firm of tliis city. *89The answer sets up the character of the paper, and expressly attacks plaintiff’s title. The case presents questions of law and fact, as follows:

First — Is the fact that the note sued upon was accommodation paper sufficient, of itself, to put the burden of proof as to title upon plaintiff; and if not, what is sufficient to shift the burden of proof ?
