This is a subrogation action brought by the Minnesota School Board Association Insurance Trust (MSBAIT) in the name of respondent Independent School District 833 (ISD 833). ISD 833 sustained property damage resulting from a roofing project. MSBAIT seeks to recover its costs incurred as ISD 833’s insurer for repairs to three elementary schools that were damaged by appellant Bor-Son Construction.
