Bradshaw v. Wilkinson Water Co.
Utah Supreme Court
1Opinion of the Court
PARRISH, Justice:
¶ 1 In this ease, we are asked to decide whether the Utah Public Service Commission (the “Commission”) erred when it required a real estate developer to bear a share of the costs of constructing facilities necessary for a local utility to supply water to the developer’s proposed subdivision. We also are asked to decide whether the Commission erred in determining that the additional demand for water attributable to the proposed subdivision may require the construction of additional facilities. We affirm the decision of the Commission on both issues.
