ORDER

SIMONS, District Judge.

The within action was tried before me and a jury on September 22nd and 23rd, 1966 in Columbia, South Carolina. During the trial motions by defendant for a directed verdict were made at appropriate stages and denied, and the case was *719submitted to the jury with instructions as to the issues involved. After deliberation for several hours the jury was unable to reach a verdict, and a mistrial was declared in due course. Defendant then moved for judgment in accordance with its motion for directed verdict pursuant to Rule 50(b) of the Federal Rules of Civil Procedure…
