MEMORANDUM OPINION AND ORDER DISMISSING CIVIL, ACTION

GADOLA, District Judge.

Before this Court is Defendants’ Motion to Dismiss and for Summary Judgment filed on May 9, 2000. Pursuant to Local Rule 7.1(e)(2), this Court has determined that oral argument will not significantly aid in the disposition of this motion. For reasons stated below, this Court will grant the relief sought by Defendants for reasons other than those raised by Defendants, and'this Court will dismiss this civil action.
