During the year 1925 Col. George Harvey, claiming to be the holder of various bonds and coupons issued by the Atlantic Coast Electric Light Company, hereinafter termed the “mortgagor,” commenced this action against the Guaranty Trust Company of New York, successor trustee under the trust indenture given to secure the series of bonds and coupons of which those referred to were part. - The plaintiff’s claim, briefly stated, is that the defendant wrongfully delivered to the mortgagor a satisfaction of the deed of trust without the knowledge or consent of the plaintiff and without payment of the…
