In March of 1991, appellant Gaetano DiGi-rolamo, Sr., and his co-defendant, Louis Salerno, were arrested in a government sting operation targeting heroin distribution in Long Island, New York. After a jury trial, both DiGirolamo and Salerno were convicted of conspiracy to distribute heroin and conspiracy to possess more than one kilogram of heroin with intent to distribute, in violation of 21 U.S.C. § 846, and of possession, with intent to distribute, of more than one kilogram of heroin, in violation of 21 U.S.C. § 841(a)(1).
