Plaintiffs, two neurologically handicapped children and their father, sued, inter alia, the School Committee of the town of Middletown, Rhode Island [hereinafter “MSC”] under the Education of All Handicapped Children Act, 20 U.S.C. § 1401, et seq. [hereinafter “EAHCA”], and the Rehabilitation Act, 29 U.S.C. § 794, claiming that federal law requires MSC to fund the special education of these children at the Landmark School in Massachusetts. 1 Plaintiffs filed this suit in May 1980 after determining that MSC had not complied with an April 1980 ruling of…
