Samuel W. Regester, and others, trading as J. Regester and Sons, sued John McCart in the Baltimore City Court in an action of covenant, and recovered a verdict upon which judgment Avas duly entered. McCart then appealed to this Court. He, as principal, and John Harris, as surety, executed an ajopeal bond Avhich Avas approved by a deputy in the office of the clerk of the City Court, the clerk himself being at that time under treatment in Spring Grove Insane Asylum for some mental disorder, though not ■ having been adjudged non compos mentis.
