Defendant Felix Antonio Martinez-Santos (“Martinez”) appeals from his sentence of 70 months imprisonment imposed by the United States District Court for the Southern District of New York,Kimba M. Wood, J., following his plea of guilty to one count of illegal re-entry into the United States after deportation, in violation of 8 U.S.C. §§ 1326(a) & (b)(2). At sentencing, the court found that Martinez had a criminal history category of V, based on a total of 12 criminal history points.
