This appeal involves a structure built by appellees, Jenny and Jeffrey Tissing upon an easement owned by the appellant North Texas Municipal Water District. The District appeals the trial court’s judgment, which found in the Tissings’ favor on the parties’ cross motions for summary judgment and dismissed the District’s claims for declaratory and injunctive relief.
