This is a habeas corpus proceeding pursuant to 28 U.S.C. § 2254. The case is presently before the Court upon the respondent’s motion to dismiss, or alternatively, for summary judgment, and upon the petitioner’s motion to strike the said respondent’s motions. By his amended petition, the petitioner seeks to have his conviction and sentence set aside in the criminal case entitled “State of Tennessee v.
