This suit was instituted by appellee, W. K. Oayton, against appellant, Diana Oil Company, a corporation, to recover damages for tbe alleged breach of a contract to drill an oil well. • Appellee alleged that he was the owner of a block of oil and gas leases located in Henderson county, which he desired to have tested; that he entered into a written contract with appellant, in which it agreed to drill a well on said acreage in consideration of a certain amount thereof and the sum of $5,000 in cash.
