This is a suit by Huffhines against Bourland and the First State Bank & Trust Company of Hereford, as depositary of SI,000 earnest money, to enforce the specific performance of a contract made between Huffhines and Bourland for the sale of certain lands alleged to belong to the plaintiff, and for the recovery against the bank of the $1,000. Bourland defends upon several grounds; mainly, because the title tendered, by Huffhines is not in accordance with the terms of the contract.
