The parties stood in the same relation in the Common Pleas Court where the plaintiffs, Wm. H. Bruns and others, filed a petition against the defendants, the County Commissioners of Sandusky county, Ohio, and the village of Woodville, Ohio, seeking damages because of a change of grade in the high way in front of plaintiff’s premises in connection with the construction by the State Highway Director of a new bridge and its approaches across the Portage river within the corporate limits of said municipality.
