—In an action to recover damages for personal injuries, the defendant appeals from (1) an order of the Supreme Court, Kings County (Mason, J.), dated August 14, 2001, which denied her motion for summary judgment *473dismissing the complaint on the ground that the plaintiff did not sustain a serious injury within the meaning of Insurance Law § 5102 (d), and (2) an order of the same court, also dated August 14, 2001, which granted the plaintiffs cross motion for summary judgment on the issue of liability.

Ordered that the orders are affirmed, with costs.
