Appeal from an order of the Supreme Court (Sise, J.), entered July 31, 2002 in Montgomery County, which partially denied the motions by defendants City of Amsterdam and Larsen Engineers P.E., L.S., P.C. to dismiss the complaint against them for failure to state a cause of action.
