Appellant was defendant below and appel-lee the plaintiff, this suit bfeing for damages resulting from a fall sustained by Mrs. Van Dusen while a patron on the premises of the .Majestic.Theater, a Dallas picture house alleged to have been operated and maintained by the defendant on said .date of December 12, 1935.
