A decree of the circuit court sustaining the defendant's demurrer to the bill as first amended was affirmed on a former appeal. Scheuer v. Britt, 217 Ala. 196, 115 So. 237.

Thereafter, by leave of the trial court, the complainant amended her bill as theretofore amended, and the demurrers interposed thereto were sustained, and this appeal is from that decree.

The bill as now amended avers, in short:
