OPINION AND ORDER

WILLIAM C. CONNER, District Judge:

Plaintiff, Record Club of America, brought this action for breach of contract against United Artists Records, Inc. (UAR), in 1972. In 1974, Record Club filed a petition in the Bankruptcy Court for the Middle District of Pennsylvania under Chapter 11 of the Bankruptcy Act. At the request of the court-appointed receiver, this action was transferred to the Court’s suspense docket. Sigmund Friedman, the president of Record Club and its sole shareholder, urged the receiver to pursue this litigation. Nevertheless, the receiver abandoned the claim.…
