On October 7,1882, the defendant in error, plaintiff below, filed his petition against the plaintiff in error, defendant below, to recover $1,000 for breach of an alleged contract for the sale of real estate. On the same day, the clerk of the court issued a summons directed to the sheriff of Jackson county. The summons was returned on October 16,1882, with the indorsement thereon that the defendant could not be found in the county.
