Ed. Dawson, plaintiff, brought this action against Mrs. H. M. King and the Murray Company, defendants, to recover damages for personal injuries received by him while in their employ. The case was submitted on special issues, and on the findings of the jury judgment was rendered in favor of plaintiff. On appeal, the judgment *165of the district court was reversed, and judgment rendered in favor of defendants. (Oiv. App.) 192 S. W. 271. This is the third appeal in this case. (Oiy. App.) 121 S. W. 917; 171 S. W. 257. Writ of error was granted herein by the Committee of Judges.
