In this patent infringement action relating to the technology of athletic shoes, the court now reconsiders its Memorandum Opinion and Order of May 17, 2005 (the “Claim Construction Order”), in light of the recent en banc opinion of the Federal Circuit Court of Appeals in Phillips v. AWH Corporation, 415 F.3d 1303 (Fed.Cir.2005). The court also herein considers Plaintiffs Motion for Partial Reconsideration of the Court’s Claim Construction Order and Memorandum in Support Thereof.
