The State Highway Department, as condemnor, appeals from a judgment based on a jury verdict establishing an award of compensation for property of condemnee taken pursuant to Ga. L. 1961, p. 517, as amended (Code Ann. § 36-1301 et seq.).

The trial court did not err in permitting certain cross examination of the condemnor’s witness by the condemnee, when thereafter the court sustained the objection to the questioning and ruled out any response thereto and instructed the jury to disregard it, and the condemnor made no further objection, motion, or request-for instruction.
