Affirming.
This is an appeal from a judgment of the Jefferson circuit court in favor of the appellee, James W. Hall, for the sum of $10,900.
Hall was an employee of the Byrne & Speed Coal Company. The Byrne & Speed coal yards are located in the city of Louisville, and extend from Eighth street to Ninth street and from Kentucky street south for one-half block. The appellant’s tracks are on Ninth street, and there is' a switch or industrial track which runs from Ninth street into the Byrne & Speed coal yards and curves^ in a northerly direction toward Kentucky…
