ORLOFSKY, District Judge:
In accordance with its independent obligation to examine the basis for the exercise of subject matter jurisdiction, see Fed. R.Civ.P. 12(h)(3), this Court on its own motion, 1 asked the parties to consider the propriety of Defendants’ removal of this action to this Court, and whether this action should be remanded to the state court from which it was removed, pursuant to 28 U.S.C. § 1447(e). 2 For the reasons set forth below, the Court finds that this action was improperly removed to this Court, and therefore, will remand the case to the Superior Court of New…
