The plaintiff has brought' habeas corpus to recover possession of his two little girls, aged 10 and 8, respectively. Defendants are the father and the sister of the deceased wife of plaintiff, mother of the children. The defense is that during her *279last illness the mother of the children confided them to the defendants, with the request that the defendants retain possession and control of them after her death; that the defendants are very much attached to them and they to defendants, and that it would be cruel to separate them and defendants ; that the welfare of the children would require…
