’Philips, J.
This is an action of ejectment for the recovery of the possession of 40 acres of land situated in the county of Bates, ouster laid in 1888. The plaintiff is recognized as a common source of title. The defendant claims title by mesne conveyances, under a tax deed. The evidence in the case shows that this land was returned as delinquent for taxes unpaid by the plaintiff thereon.
