I. INTRODUCTION
Jeffrey Kirby (“Kirby”) brings this suit against the Yonkers School District (the “District”) and Bernard Pierorazio (“Pierorázio”), the Superintendent of the District, (together, the “Defendants”) alleging violations of his First and Fourteenth Amendment rights, and of New York state law.
